Article 64: Filling of vacancies

When the seat of any member of the House of Representatives becomes vacant the vacancy shall be filled in such manner as may be prescribed by or under any law for the time being in force in Malta or, if no provision is made by any such law, by the election of another member.

Where the seat of a member of the House of Representatives becomes vacant and no other provision is made by or under any law for the time being in force in Malta for the filling of such vacancy, an election to fill the vacancy shall be held not later than three months from the date on which the vacancy was notified to the Electoral Commission.

This article establishes the procedures for filling vacancies in the House of Representatives, either through methods prescribed by law or through by-elections, with a timeframe for holding such elections when no other provision exists.
