Article 43: Prohibition of deportation

No citizen of Malta shall be deported from Malta except as a result of an extradition order made under a law providing for extradition on account of a criminal offence or any removal order under a law providing for the removal of a person from Malta in the interests of defence, public safety, public order, public morality or decency or public health.

The prohibition contained in sub-article (1) of this article shall not preclude the making of any law providing for the imposition of restrictions on the freedom of movement or residence within Malta of citizens of Malta in general or of any particular class of such citizens.

Notes

This article prohibits the deportation of Maltese citizens except under specific conditions related to extradition for criminal offenses or removal in the interest of public safety, defense, order, morality, or health.
